Every
USA Premium Leather Furniture piece is built in Salt Lake City, Utah, from
kiln-dried hardwood, coil spring suspension, and top-grain leather. We build
them to last, and we stand behind that construction with the warranty terms
below.
USA Premium Leather Furniture
(“USA Leather”) warrants its upholstered furniture to the original retail
purchaser, as set forth below, when purchased new from an authorized USA
Leather dealer for use in a residential setting. This warranty is not transferable.
Coverage Periods
The following coverage periods
begin on the date of delivery to the original retail purchaser:
Lifetime Limited Coverage

Hardwood structural frame components
•
Coil spring suspension system
2-Year Limited Coverage
•
Reclining mechanisms (metal mechanism components:
links, hinges, cross-tubes, pivot rivets)
•
Sleeper, swivel, glider, and rocker mechanisms (metal
components)
•
Power components: motors, transformers, hand controls,
USB ports, junction boxes
1-Year Limited Coverage
•
Leather upholstery, against manufacturing defects only
•
Fiber and feather/down filling materials
•
Decorative hardware, leg finishes, casters
•
Cushion cores, against loss of foam resiliency only
(not against normal softening, flattening, or conforming to user)
•
All other components not specified above
Definition of “Lifetime”
“Lifetime” means the period
during which the original retail purchaser owns the product and the product
remains in its original USA Leather upholstery, ending when any of the
following occurs, whichever comes first:
(a) The product is
recovered, reupholstered, or the original USA Leather upholstery is replaced,
repaired, or substituted in whole or in part, whether by USA Leather, an
authorized service provider, or any third party;
(b) The product is sold,
gifted, donated, or otherwise transferred to any party other than the original
retail purchaser;
(c) The product is moved
out of the original delivery address into a commercial, rental, contract,
hospitality, or other non-single-family residential setting;
(d) USA Leather
determines, in its reasonable judgment based on physical or photographic
inspection, that the original leather upholstery no longer performs its
intended function as upholstery.
For purposes of this warranty,
“original USA Leather upholstery” means the leather panels, cushions, and
covers manufactured and applied by USA Leather as delivered to the original
retail purchaser, without subsequent replacement, repair, recovering, or substitution.
How to File a Claim — All Claims Through the Original Selling Retailer
All warranty claims must be
initiated through the authorized USA Leather dealer or retailer from whom the
product was originally purchased. The original selling retailer holds the
record of purchase, verifies the original purchaser, and serves as the claim
intake channel for USA Leather.
The original retail purchaser
should:
1.
Contact the original selling retailer within thirty
(30) days of discovering the issue. Defects must be reported within thirty (30)
days of the date the original retail purchaser first discovers, or reasonably
should have discovered, the issue. Claims reported substantially later may be
denied at USA Leather’s sole discretion.
2.
Provide the retailer with: original order or invoice
information; date of delivery; clear photographs showing the full piece, the
under-frame tag with model and lot number, the area of concern in context, and
a close-up of the alleged defect; and a written description of the issue
including when it first appeared and the conditions of use.
3.
Await written claim authorization. No repair work is
authorized, and no repair costs will be reimbursed by USA Leather, until USA
Leather issues a written claim authorization to the retailer.
The retailer will: verify
the customer as the original purchaser, confirm the delivery address and date
from retailer records, perform initial photographic triage, and submit
qualifying claims to USA Leather for evaluation. USA Leather deals directly
with the retailer, not with the end customer, on all warranty matters.
USA Leather reserves the right
to inspect the product, in person or by photograph, prior to authorizing any
repair or replacement.
Cost Responsibility
For claims authorized as covered
under this warranty:
•
Within the first year of delivery: USA Leather
will cover materials, labor, and shipping required for the authorized repair or
replacement.
•
After the first year of delivery: For components
covered beyond one year, USA Leather will cover materials only. The original
retail purchaser is responsible for all labor, shipping, in-home service, and
other costs of performing the authorized repair or replacement.
Remedy
USA Leather’s sole obligation
under this warranty is, at USA Leather’s sole option, to (a) repair the
defective component, (b) replace the defective component with a component of
comparable specification, or (c) refund the original purchase price of the affected
component. Replacement components may differ from the original due to
variations in leather, material availability, and product evolution; reasonable
substitution is at USA Leather’s discretion.
THE OBLIGATIONS OF USA
LEATHER UNDER THIS WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE
NON-CONFORMING PRODUCT.
What is NOT Covered
This warranty does not cover,
and USA Leather disclaims any obligation for, the following:
Natural characteristics of
leather, which are not defects:
Variations in color, grain,
texture, and softness between hides and within a single hide; healed scars,
insect bites, neck wrinkles, and growth marks; color migration to or from
leather caused by clothing dyes, denim, or other materials; natural softening,
stretching, and the formation of seat impressions and body indents with use;
color changes due to light exposure over time.
Normal wear and tear, which
is not a defect:
Softening, flattening, and
compression of foam, fiber, and feather/down fillings (compression of up to one
inch in the first year of use is normal); minor squeaks, sounds, or noise in
mechanisms or springs; surface scuffs, scratches, and finish wear on leg
finishes and decorative hardware; loosening that can be corrected by normal
tightening of accessible fasteners.
Environmental damage:
Damage from direct or prolonged
sunlight exposure; damage from proximity to heat sources, radiators, or
fireplaces; damage from low humidity environments below 35% relative humidity,
including leather drying, splitting, or cracking; damage from high humidity,
mildew, or water exposure.
Use and care damage:
Damage from pets (claw marks,
chewing, urine, oils); damage from body oils, perspiration, hair products,
lotions, medications, or other transferred substances; damage from spills,
including but not limited to food, beverages, ink, dye, paint, bodily fluids,
and household chemicals; damage from improper cleaning, including use of
cleaning products not approved in the USA Leather Care & Maintenance Guide;
damage from any chemical treatment, protectant, or after-market product applied
to the leather; damage from misuse, abuse, accident, or negligence; damage
incurred during customer-arranged moving, storage, delivery, or installation;
damage from use other than ordinary single-family residential use.
Cosmetic and dimensional
matters:
Differences in color, grain, or
texture between the floor sample or photograph and the delivered product; minor
variations in dimension (up to ½ inch) from published specifications;
differences between the original product and any replacement parts provided
under this warranty, as leather and material inventories change over time.
Voiding events:
This warranty is void as to any
product that has been (a) repaired, modified, or serviced by anyone other than
USA Leather or a USA Leather-authorized service provider; (b) recovered or
reupholstered in whole or in part; (c) used in any commercial, rental,
contract, hospitality, or non-single-family residential setting; (d) acquired
through any liquidation, going-out-of-business, “as-is,” or floor-sample sale;
(e) acquired secondhand or through any party other than an authorized USA
Leather dealer; (f) for which the customer cannot be verified as the original
retail purchaser through the original selling retailer’s records.
Limitations
ALL IMPLIED WARRANTIES,
INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO ONE (1) YEAR FROM THE DATE OF
DELIVERY. IN NO EVENT SHALL USA LEATHER BE LIABLE FOR INCIDENTAL OR
CONSEQUENTIAL DAMAGES.
Some states do not allow
limitations on how long an implied warranty lasts, or the exclusion or
limitation of incidental or consequential damages, so the above limitations may
not apply to you. This warranty gives you specific legal rights, and you may also
have other rights which vary from state to state.
Authority
This Limited Warranty
establishes the original retail purchaser’s exclusive remedies. No
representative, dealer, retailer, employee, or agent of USA Leather has any
authority to increase, alter, or extend the obligations or limitations of this
warranty. Any amendment to this warranty is effective only when executed in
writing by an authorized officer of USA Leather.
